J&K Govt Amends Family Pension Rules; Enhanced Family Pension After Retiree’s Death Extended Up to 7 Years

Pending cases to be decided under amended rules; already settled cases will not be reopened

Srinagar, July 21: The Jammu and Kashmir Government has amended the J&K Family Pension-cum-Gratuity Rules, 1964, providing enhanced family pension for the families of retired government servants who die after retirement for a period of seven years, or until the deceased would have attained the age of 67 years, whichever is earlier.

As per a notification issued by the Finance Department, a copy of which lies with the news agency JKNS, the amendment has been made through S.O. 204, issued in exercise of powers under the proviso to Article 309 of the Constitution of India.

The notification provides that in the event of the death of a government servant after retirement, the family pension at enhanced rates shall be payable for seven years, or up to the date on which the deceased retired government servant would have attained the age of 67 years, whichever is less.

It further states that cases already settled under the rules existing prior to the issuance of the notification shall not be reopened. However, all pending cases, if any, on the date of issuance of the notification shall be decided in accordance with the amended provisions.

The amendment has been incorporated as the second proviso below Note 4 of Rule 20 of the Jammu and Kashmir Family Pension-cum-Gratuity Rules, 1964, contained in Schedule XV of the Jammu and Kashmir Civil Service Regulations, Volume II.

The notification has been issued by order of the Lieutenant Governor and signed by Shailendra Kumar, IAS, Financial Commissioner (Additional Chief Secretary), Finance Department. It shall come into force from the date of its publication in the Official Gazette. (JKNS)
